As such, here are the developments:
In an official announcement in June 2021, the NCAA stated that college athletes would have the opportunity to benefit from their NIL when governance bodies in all three divisions adopted a uniform interim policy suspending NCAA name, image and likeness rules for all incoming and current student-athletes in all sports. Early adopters of NIL policy such as Florida aim to remove clauses in the original wording of the legislation due to potential disadvantages. Florida’s NIL law, which went into effect on July 1, 2021, put increased restrictions on college athletes that the NCAA did not include with their NIL policy.
Connecticut hopes to increase protections for college athletes monetizing their NIL by updated the current policy to include logos and institutional marks. It is the hope of lawmakers that athletes can engage in sponsorship opportunities while sporting marks of their own college team, which currently is not allowed. This law would be the first of its kind and will be a first step to assuaging a major point of anxiety for current college athletes.
Alabama aims to repeal their NIL law outright. Once again, since the NCAA’s policy is much looser than state laws that were enacted last year, it leaves these states at a huge disadvantage. It seems that states do not want to lose this competitive edge for their athletes. A full repeal would allow NIL to be dictated by the NCAA.
